NORTHEASTERN PROPERTY MANAGEMENT SOLUTIONS, INC.

GENERAL

This agreement is made between Northeastern Property Management, Inc. (Property Manager) and [Landlord First Name, Last Name] on [Date]. The Property included in this agreement is [Property Address]. This Property is located in [City, State]. The Terms and Conditions of this agreement are outlined below.

TERMS AND CONDITIONS

  1. The contract is binding as of the date of transfer of ownership proposed August 30th, 2019. A written notice from the [Landlord First Name, Last Name] to the Property Manager of no less than 30 days is required to terminate this contract.

  2. The cost for service is as follows: 8% of gross rents collected per month is charged for retainer fee. This cost includes fielding tenant trouble calls and discussing options for repairs or problem resolution. normal working hour trouble calls requiring property visits or project oversight. Additionally, any further property visits for trouble calls outside of normal working hours or special projects will be charged $45.00 per hour, 2 hour minimum to cover travel time to and from [Property Address]. Normal working hours are defined as Monday through Friday 8 a.m. through 6 p.m. Additional charges for materials, contractors or tradesmen will be applied.

  3. Items that the Property Manager will address are as follows: Emergency calls, minor repairs that are of safety concern, and other routine issues that arise due to damage or wear and tear. The Property Manager will not perform any repairs without contacting the Landlord for permission and will not perform repairs that can bring undue liability to the Property Manager. Large projects, jobs requiring licenses or permits will not be performed by the Property Manager. They can be performed at additional cost to the [Landlord First Name, Last Name] and will be discussed outside of this agreement.

RENT COLLECTION

  1. Rent collections will be done by the Property Manager. All delinquent payments will be handled by [Landlord First Name, Last Name]. Any constable, court and legal fees will be paid for by [Landlord First Name, Last Name].

  2. The Property Manager will place tenants into apartments at a cost of ½ of one month’s rent or $650 dollars, whichever is greater. The Property Manager will guarantee a private tenant for 6 months and will guarantee a housing voucher tenant for one year. If a tenant leaves or is evicted during the guarantee period, the Property Manager will replace the tenant free of charge.

EMERGENCY MANAGEMENT PROTOCOL

  1. Trouble calls deemed critical emergencies or hazards to life or property will be addressed within a 13 hour window. If the emergency is electrical or plumbing related, the Property Manager will dispatch the appropriate tradesman as soon as possible. Any other trouble calls considered normal or routine will be addressed in a 24 hour window. The Property Manager will contact the [Landlord First Name, Last Name] to inform of the issues and emergencies that arise.

  2. If the Property Manager is not going to be in the area due to other obligations, the Property Manager will inform the [Landlord First Name, Last Name] of this in a timely fashion to allow for the [Landlord First Name, Last Name] to make other arrangements.

  3. The Property Manager requests that tenants do not call after 8:30 pm unless there is a critical emergency i.e. flooding, pipe break, electrical issue, fire. Any routine breakdowns or issues can be addressed via text message 24 hours a day. Tenants are encouraged to call the Property Manager between the hours of 8am and 8:30pm, 365 days a year.

  4. Any amendments or further services requested by the [Landlord First Name, Last Name] will be discussed and this agreement will be modified or terminated, at both the Property Manager’s and [Landlord First Name, Last Name] mutual understanding.

INDEMNIFICIATION

  1. [Landlord First Name, Last Name] shall indemnify, defend and hold harmless Property Manager from and against, and, upon demand, reimburse Property Manager for, all claims, demands, liabilities, losses, damages, judgments, penalties, costs and expenses, including, without limitation, reasonable attorneys' fees and disbursements, which may be imposed upon, asserted against or incurred or paid by Property Manager by reason of, on account of or in connection with any bodily injury or death or property damage occurring in, upon or in the vicinity of the Property through any cause whatsoever, or asserted against Property Manager on account of any act performed or omitted, except as a result of the willful misconduct or gross negligence of Property Manager. [Landlord First Name, Last Name] shall further indemnify, defend and hold harmless Property Manager from and against any losses, costs or expenses resulting from any claims or demands made against the Property by any and all persons, including, without limitation, from and against any losses, costs or expenses resulting from any claims or demands made by any and all persons.

INSURANCE

  1. [Landlord First Name, Last Name] shall pay for the appropriate policy of insurance to insure that Property Manager shall have no responsibility for injury, accident, casualty or bodily injury occurring at The Property.

  2. The Property Manager reserves the right to refuse to perform services he feels as unsafe or outside of his areas of knowledge.

  3. The Property Manager reserves the right to refuse a property visit if he feels his safety is in jeopardy.

  4. Issues that are identified must be communicated to the Property Manager in a timely fashion as to allow for prompt issue resolution. It is ultimately [Landlord First Name, Last Name] responsibility for the safety and maintenance of The Property.
